A new ordinance that was recently passed. If you have already talked about this, sorry, I must have missed it. http://www.youtube.com/watch?v=qIJdqzYyoCQ&feature=feedlik Government does not tell the people what is in their best interest, people tell the government what is in their best interest. Ordinance #2740( An unfunded city-wide mandate) was passed with a resounding 6 to 1 vote, and it allows for the citizens of Cedar Falls, Iowa to forcefully give the government keys to their comercial properties through universal 'lock boxes'. The intent of the program is to provide increased safety and protection to personal, private property which include businesses, apartments and some rental houses-- which by the way-- comes at the expense of furthering wayward erosion of fundamental constitutional rights. You might want to send a fax to the Cedar Falls City Council and let them know what you think of their statist plan to have access to private property in the name of 'protecting citizens'. Obviously this is pretty egregious, but is it really unconstitutional? I generally associate patrons of this site with constitutional originalism. In that context, what do the people who visit here think of (constitutional) incorporation?

Incorporation basically eliminates states rights. It's an abomination.

boneman, in the context of the federalism that our founders might have envisioned (or at least a good number of them), I think you're exactly right. That's why I'm calling the claim of "unconstitutionality" into question. I think it's perfectly fine to call out local or state governments for bad policies. But I think supposed conservatives do themselves a disservice when they unwittingly try to use incorporation to bring those local issues into federal purview (even on things like firearm restrictions). Then again, I'm not quite sure that most people who support the Constitution understand that it wasn't intended to apply to state and local governments.

Agree completely. If the U.S Constitution was intended to be applied to the states, what is the purpose of a state constitution?

Most people have no idea what it would be like to live under the Constitution as it was intended.
